Terms of Service

These Terms of Service ("Terms") govern your use of the Pacer mobile application for iPhone and Apple Watch and the website at aipacerapp.com (together, the "Service"), provided by Pacer ("Pacer," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Pacer is an on-device AI running coach that reads health and fitness data you choose to share to generate training plans, readiness insights, and workout guidance for your iPhone and Apple Watch. Features, content, and availability may change over time.
2. Health and safety disclaimer
The plans, paces, heart-rate targets, and recommendations Pacer provides are general fitness guidance based on the data available to it and may not be appropriate for you. They are not a substitute for professional medical, nutritional, or athletic advice. You are responsible for exercising judgment and listening to your body. Pacer is not responsible for any injury, health condition, or loss arising from your use of the Service.
3. Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. By using it, you represent that you meet this requirement and that you are capable of forming a binding contract.
4. Your device and data
You are responsible for the device you use and for the accuracy of the data you connect. Granting Pacer access to Apple Health data is optional and controlled by you through iOS. Our handling of that data is described in our Privacy Policy.
5. Purchases, pricing, and refunds
Pacer offers free features and an optional one-time "Pro" purchase. All purchases are processed by Apple through the App Store and are subject to Apple's terms. Prices are shown before purchase and may change for future purchases. Refunds are handled by Apple under the App Store's refund policy; we are generally unable to issue refunds directly.
6. Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract the source code or models of the Service, except where permitted by law;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service;
- use the Service to violate any law or the rights of others; or
- resell, redistribute, or commercially exploit the Service without our permission.
7. Intellectual property
The Service, including its software, design, content, and trademarks, is owned by Pacer or its licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms.
8. Third-party services
The Service relies on Apple platforms and services (including HealthKit, the App Store, and the Apple Push Notification service). Your use of those services is governed by Apple's terms, and we are not responsible for them.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACER AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold Pacer harmless from claims, damages, and expenses arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
12. Changes and termination
We may update the Service or these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. We may suspend or end the Service, or your access to it, if you violate these Terms. You may stop using the Service at any time by deleting the app.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Pacer is established, without regard to conflict-of-laws principles. Nothing in these Terms limits any rights you have under mandatory consumer-protection laws in your place of residence.
